Environmental Site Assessments

Environmental Site AssessmentsMost real estate transactions now require environmental assessment of the site, required by lenders, and required by owners (sellers and/or buyers) exercising due diligence and seeking to put into place an "innocent landowner" defense against future environmental cleanup claims against the property in question.  The "Phase I" assessment involves an "environmental professional" conducting interviews with past and present owners, operators and occupants; searching for environmental cleanup liens; review of federal, tribal, state and local government records; a visual inspection of the property (and in some cases adjoining property); and a declaration by the "environmental professional" regarding any "data gaps" (missing information that could affect the discovery of hazardous conditions or contamination on a site).  Bodine Services has the "environmental professionals" with certifications and experience to conduct all phases, including Phase II which can involve soil sampling, ground water sampling, indoor air quality testing, drums and waste materials testing, asbestos testing, and underground tank testing, and Phase III, full site/remedial investigation and selection of an appropriate/feasible remedy for contamination found in the first two phases.  Bodine Services is a certified Illinois EPA Emergency Response Contractor and an Illinois EPA Corrective Action Contractor.

Site Investigation Consulting

Site InvestigationFederal law requires that a site investigation include an "all appropriate inquiry" which must include these ten areas of investigation:

  • The results of an inquiry by an environmental professional;
  • Interviews with past and present owners, operators, and occupants of the facility for the purpose of gathering information regarding the potential for contamination at the facility;
  • Reviews of historical sources, such as chain of title documents, aerial photographs, building department records, and land-use records, to determine previous uses and occupancies of the real property since the property was first developed;
  • Searches for recorded environmental clean-up liens against the facility that are filed under federal, state, or local law;
  • Reviews of federal, state, and local government records, waste disposal records, underground storage tank records, and hazardous waste handling, generation, treatment, disposal, and spill records concerning contamination at or near the facility;
  • Visual inspections of the facility and adjoining properties;
  • Specialized knowledge or experience on the part of the owner;
  • The relationship of the purchase price to the value of the property if the property was not contaminated;
  • Commonly known or reasonably ascertainable information about the property; and
  • The degree of obviousness of the presence or likely presence of contamination at the property and the ability to detect the contamination by appropriate investigation.

Remedial Design

Remedial DesignRemedial Design is the phase in Superfund site cleanup where the technical specifications for cleanup remedies and technologies are designed.  This involves a schedule of work, contracting with the EPA and other involved parties, developing a plan for project management, developing the specific remedial design and cost estimates, and planning for oversight of the project.  Bodine Services has the equipment, experience, and trained, certified personnel to ensure that your project is completed in accordance with all pertinent laws and regulations.

Site Remediation

Brownfield RedevelopmentA "brownfield" is a property which cannot be expanded, re-used, or re-developed due to the presence of pollutants, contaminants, or hazardous material.
